Terms and Conditions

These terms and conditions (which may be modified from time to time) apply to all direct or indirect services (through distributors) available online, through any mobile device, by email, or by telephone.

By accessing, browsing, and using our website or any of our applications available through platforms ("the website") and/or making a reservation, you agree to have read, understood, and agreed to the terms and conditions displayed below (including the privacy section).

1. Scope of Our Service

Through this website, we (Tolhuin Tours and its affiliates) provide an online platform through which all types of activities, excursions, accommodations, and services offer their products, and website users can make reservations.

When making a reservation through Tolhuin Tours, you establish a direct (legally binding) contractual relationship with the establishment where you have booked. From the moment you make your reservation, we act as intermediaries between you and the establishment, transmitting the reservation data to the establishment, and subsequently sending you various emails to complete the contract on behalf of the establishment.

The information we display is based on information provided to us by the providers. Although we try to make our service as accurate as possible, we cannot verify or guarantee that all information is accurate, complete, or correct. We are also not responsible for errors (such as obvious and typographical errors), interruptions (due to temporary and/or partial server downtime or repairs, updates and maintenance of our website or other reasons), inaccurate, misleading or false information, or lack of information.

2. Prices and Best Price Guarantee

Prices appearing on our website are expressed in US dollars.

All prices on the Tolhuin Tours website are displayed with taxes included and are subject to change of said taxes, unless otherwise indicated on our website or in the confirmation email.

3. Cancellation Policy and No-Show

When making a reservation for an activity, excursion, or service, you accept its cancellation and no-show conditions, as well as other additional terms and conditions that may affect your reservation.

A "No-Show" is defined as not showing up for the reserved tour without prior notice, or communicating your intention not to attend less than 24 hours before the tour date.

Please note that a reservation that requires payment of a deposit or advance payment (total or partial) may be canceled (without prior notice) if said deposit has not been paid on its corresponding date.

With Cancellation Insurance

If you contracted the cancellation insurance during the booking process:

  • If you cancel a tour more than 24 hours before the tour date, a full refund of the reservation will be made to the same card or payment method used. Medical or other justifications are not necessary to cancel.
  • There are NO additional charges for "No Show." If you do not show up or cancel within 24 hours of the tour, the remaining amount will not be charged.
  • The amount paid for the cancellation insurance will not be refunded.

Without Cancellation Insurance

If you did NOT contract the cancellation insurance during the booking process:

  • If you cancel a tour, NO refund of the paid reservation will be made under any circumstances.
  • If you cancel a tour less than 24 hours before the tour date, the remaining tour amount will be charged for No-Show.

4. Date Modifications and Force Majeure

With Cancellation Insurance

  • You may modify the tour date by giving at least 24 hours notice before the scheduled date. This applies for a maximum of 2 date changes.
  • If the tour must change dates due to weather conditions, you decide whether you can do it on the new date. If you cannot, you may request cancellation and obtain 100% of the paid reservation. If you can move the date, the tour will be conducted on the new date.

Without Cancellation Insurance

  • You may NOT modify the tour date under any circumstances.
  • If the tour must change dates due to weather conditions (always justified by ONAMET), a new ticket will be sent with the new tour date. If you can do it on the new date, it will be conducted normally. If you do not have availability, you are NOT entitled to cancellation, without right to refund of the paid reservation.

5. Payment of Remaining Balance by Credit Card

Payment of the remaining balance for contracted services can be made by credit or debit card at the destination in some cases, but this payment method carries a supplement of 10% to 18% of the remaining amount to be paid, depending on the provider, due to fees imposed by the bank's payment gateways.

6. Privacy and Cookies

Tolhuin Tours respects your privacy. We only place cookies, access, and use non-sensitive information from your device to improve our products and personalize ads and other content on this website.

7. Additional Correspondence

By making a reservation, you agree to receive an email, which we may send you shortly before your arrival date, where you will find information about the destination and other data and offers. You also agree to receive an email, which we may send you after your stay in the country, inviting you to complete a review form.

8. Intellectual Property Rights

Unless otherwise indicated, the software necessary for our services or used on our website and the intellectual property rights (including copyrights) of the contents and information, as well as the material on our website belong to Tolhuin Tours, its suppliers, or distributors.

The contractor of our services authorizes Tolhuin Tours to use photographs or videos taken by our staff on any of our tours, where they appear. These images may be used on Tolhuin Tours' official platforms for promotion of our products (tours).

If you do not agree with the use of these images, the contractor can inform us by writing to tolhuintours@gmail.com, and Tolhuin Tours will proceed to remove them from all media used.

9. Miscellaneous

To the extent permitted by law, these terms and conditions and the provision of our services shall be governed and interpreted in accordance with the laws in force in the Dominican Republic, and any dispute arising from these general terms and conditions and our services shall be presented solely before the competent Courts of Higüey, in the Dominican Republic.

The original English version of these terms and conditions has been translated into other languages. The translated version is a courtesy and unofficial translation, therefore no rights can be derived from the translation.

If any provision of these terms and conditions is or becomes invalid or non-binding, you will continue to be bound by the remaining provisions mentioned. If this were to occur, the invalid provision must be fulfilled to the maximum permitted by applicable law and, to the extent possible, an effect similar to the invalid or non-binding provisions will be accepted, in accordance with the content and purpose of these terms and conditions.

10. About Tolhuin Tours

Tolhuin Tours (brand of representation) provides activity and excursion sales services in Punta Cana and Bayahibe from this website (www.tolhuintours.com), which is owned by TOLHUIN TOURS LLC.

The different tourist services offered on our website have a tourist license (granted by MITUR), and accident and civil liability insurance (with Banreservas Seguros), both in force, which we make available to our clients and competent authorities, exclusively in person, for fraud prevention reasons and data protection law.
